These Terms of Use (the “Terms”) govern your use of the website www.nodmeals.com (the “Website”) and the NodMeals mobile application (the “App”), collectively referred to as the “Services”. Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to abide by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, you may not use the Services.

2. Ownership and Operation

The Services are operated and owned by NodMeals Pvt Ltd, a company registered in Mumbai (referred to as “NodMeals”, “we”, “us” or “our”).

3. Changes to Terms of Use

We reserve the right to modify these Terms at any time by posting the updated version on the Website. You should regularly review these Terms. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

4. How the Services Work

4.1 NodMeals Services: NodMeals is an online catering and meal delivery platform that connects customers with catering services for events and meal orders. We offer catering services provided by a variety of vendors listed on the Services (the “Vendors”).

4.2 Payment: You may pay for your catering orders either online through credit/debit cards or net banking, or cash on delivery, depending on your location and the vendor’s payment policy.

4.3 Role of NodMeals: NodMeals acts as an intermediary between you and the Vendor. We facilitate the order placement and payment process but do not directly provide catering services or prepare food.

5. Account Registration

5.1 Creating an Account: To access certain features of the Services, you may need to create a NodMeals account (“Account”). You can also log in via Third-Party Accounts such as Facebook.

5.2 Account Information: You agree to provide accurate, current, and complete information during registration and to update this information as needed.

5.3 Account Security: You are responsible for maintaining the confidentiality of your Account credentials. Notify us immediately of any unauthorized access to your account.

6. Bookings and Financial Terms

6.1 Placing an Order: After selecting a catering service or meal, you can place an order, subject to availability and delivery location restrictions.

6.2 Order Confirmation: Once your order is confirmed, you will receive a notification. We may contact you for additional confirmation.

6.3 Payment: You agree to pay the total amount for any order placed, including applicable taxes and delivery fees. All payments are processed through third-party payment processors.

7. Cancellations and Refunds

7.1 Order Cancellation: Orders cannot be canceled once confirmed unless items are unavailable or there is an issue with the delivery.

7.2 Refund Eligibility: You are eligible for a refund if your order is canceled by us, if the food is damaged, or if there is an issue with the delivery.

7.3 Refund Process: Refunds will be processed to your payment method within 3-5 business days.

8. Terms of Service

8.1 Vendor Responsibilities: NodMeals does not own or manage the vendors providing the catering services. We are not responsible for the quality of the food or service.

8.2 Service Availability: Delivery availability depends on your location and the vendor’s service area. We will notify you if your order is outside the delivery zone.

8.3 Delivery Time: The estimated delivery time is an approximation and may vary based on circumstances.

8.4 Customer Obligations: You must provide correct delivery information and accept the order once delivered. We are not liable for any issues caused by incorrect information.

9. No Endorsement

9.1 Vendor Relationships: We do not endorse any vendor. Your interactions with vendors are at your own risk.

9.2 Limitation of Liability: Any disputes with vendors are between you and the vendor. We are not liable for any damages arising from such interactions.

10. General Terms

10.1 Age Requirement: You must be 18 years or older to use the Services. If under 18, your parent or guardian must agree to these Terms on your behalf.

10.2 Account Security: You are responsible for all activities under your account. Do not share your password with third parties.

10.3 Service Area: The Services are available in Mumbai and Pune. If accessed from outside these areas, you do so at your own risk.

10.4 Costs: You are responsible for any costs related to your access to the Services, including data and internet charges.

10.5 Promotions and Communication: By using the Services, you consent to receiving promotional messages. You can opt-out by contacting us at support@nodmeals.com.

10.6 Usage Restrictions: You agree not to misuse the Services. Any content or activity that violates local, state, or national laws is prohibited.

10.7 Account Termination: We may suspend or terminate your Account if you violate these Terms.

10.8 Service Discontinuation: We reserve the right to modify or discontinue the Services at any time.

11. Access to the Services, Accuracy, and Security

11.1 Availability of Services: We strive to make our Services available to you during vendor working hours. However, we do not guarantee that access to the Services will be uninterrupted, timely, error-free, or free from viruses or other harmful components. We are not obligated to correct any defects that arise.

11.2 Compatibility and Security: We do not guarantee that the Services will be compatible with all hardware or software you may use. We are not liable for any damage caused to your devices, software, data, or other property as a result of downloading, installing, or using the Services. This includes any issues arising from viruses or harmful code. Additionally, we are not liable for actions taken by third parties.

11.3 Accuracy of Information: While we make every effort to ensure the accuracy of the content on our Services, we do not represent or warrant that the information provided is always correct, complete, or reliable.

12. Relationship with Platform Operators if the Services is Accessed via Mobile Devices

12.1 Third-Party Platforms: If you access the Services via a mobile device, please note that the Services are not affiliated with, endorsed by, or in any way linked to platform operators such as Apple, Google, Android, or any other third-party platform (collectively referred to as “Operators”).

12.2 Third-Party Terms: Your use of the Services through an Operator is governed by the terms and conditions of that Operator. By accessing or using the Services, you agree to comply with the applicable terms of the Operator.

12.3 Sole Responsibility: These Terms of Use are an agreement solely between you and NodMeals. We, not the Operators, are responsible for the Services and the content thereof.

12.4 Limited License: We grant you a limited, non-transferable license to use the Services on a mobile device that you own or control, in accordance with these Terms.

12.5 Maintenance and Support: We, and not the Operator, are solely responsible for providing any maintenance and support for the Services, as required by applicable law. Operators are not responsible for providing such services.

12.6 Third-Party Claims: We, not the Operator, are solely responsible for addressing any claims from you or third parties related to the Services, including compliance with legal or regulatory requirements, and intellectual property infringement claims.

12.7 Compliance with Third-Party Agreements: You are required to comply with any third-party terms when using the Services, such as your mobile device agreement or wireless data service agreement.

12.8 Third-Party Beneficiaries: Operators and their subsidiaries are third-party beneficiaries of these Terms, with the right to enforce the Terms against you.

13. Disclaimers

13.1 Continuous Upgrades: The Services may be under constant upgrades, and some features or functions may not be fully operational at all times.

13.2 Information Limitations: Due to the limitations in the electronic distribution of information and data sourced from various providers, there may be inaccuracies, delays, or omissions in the content or functionality of the Services. We do not guarantee the accuracy of the information provided.

13.3 Liability Disclaimer for Unauthorized Transactions: We expressly disclaim all liabilities related to unauthorized use of credit/debit cards or other payment methods.

13.4 Third-Party Services: We may form partnerships or alliances with third-party vendors to provide additional services on the platform. However, we do not make any guarantees or warranties regarding the services of third parties, nor are we liable for any issues or claims arising from these third parties, including but not limited to injury, death, or harm to you or others.

13.5 No Guarantees of Professional Qualifications: While we provide information about services, we make no guarantees regarding professional qualifications, expertise, or the quality of work. We do not endorse any specific vendor or service on the platform, and we are not liable for decisions made based on the information provided.
